These Terms of Service ("Terms") are a binding agreement between you and Comfort Heating & Air, LLC d/b/a Comfort Heating & Air ("Comfort Heating & Air," "we," "us," or "our"), a Kansas limited liability company, governing your access to and use of salinacomfort.com (the "Site") and any related request-service, financing-referral, or informational features (together, the "Services"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Acceptance & Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Site to request service or submit information to us. By using the Site you represent that you meet these requirements and that any information you submit is accurate.

2. Description of Services

Comfort Heating & Air provides this Site as a way for Central Kansas residential and commercial customers to learn about our HVAC installation, repair, and maintenance services, request service, view financing information, and contact us. Actual HVAC service is performed under a separate service agreement, work order, or invoice between you and Comfort Heating & Air, not through this Site.

3. AI & Automated-Content Disclaimer

The Site may use artificial-intelligence tools to help generate written content (such as blog articles or service descriptions) and, if enabled in the future, to power a chat assistant or automated estimator. AI-generated or AI-assisted output is provided for general informational purposes only, may be illustrative, incomplete, or inaccurate, and is not professional, engineering, or code-compliance advice. We apply human review to AI-assisted content before publishing it, but we do not guarantee its accuracy or completeness, and it does not replace an in-person diagnosis, inspection, or quote from a licensed technician. Do not rely on AI-generated content or outputs as a substitute for consulting our technicians about your specific equipment or situation.

4. Estimates & Quotes Are Non-Binding

Any price range, estimate, or quote shown on the Site, given over the phone, or provided by an AI-assisted tool is preliminary and non-binding until confirmed in a signed written service agreement, work order, or invoice reflecting an on-site inspection of your specific system and conditions. Final pricing may differ from any preliminary estimate based on the actual scope of work discovered on-site.

5. No Professional Advice

Content on the Site — including blog posts, service descriptions, and any AI-assisted content — is provided for general informational purposes only and does not constitute professional HVAC, engineering, electrical, or code-compliance advice specific to your property. Always have a licensed technician evaluate your specific system before making repair, replacement, or safety decisions.

6. Intellectual Property & Limited License

The Site and its content — including text, graphics, logos, photographs, and design — are owned by Comfort Heating & Air or our licensors and are protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own personal or internal business purposes related to obtaining information about or requesting our Services. You may not copy, reproduce, republish, scrape, frame, or create derivative works from the Site's content without our prior written permission.

7. Acceptable Use

You agree not to:

Any financing application, approval, credit decision, and repayment terms are between you and Optimus under Optimus's own terms and privacy policy; we are not a party to that financing agreement and are not responsible for Optimus's decisions or practices. The Site may also link to third-party sites (such as review platforms or social media) that we do not control and are not responsible for.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT, INFORMATION, ESTIMATES, AND FEATURES ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT (INCLUDING AI-ASSISTED CONTENT OR ESTIMATES) IS ACCURATE, COMPLETE, OR CURRENT. THIS SECTION DOES NOT AFFECT ANY SEPARATE WRITTEN WARRANTY WE PROVIDE ON ACTUAL INSTALLED EQUIPMENT OR LABOR UNDER A SIGNED SERVICE AGREEMENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COMFORT HEATING & AIR AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE (AS OPPOSED TO ACTUAL HVAC SERVICES PERFORMED UNDER A SEPARATE SIGNED SERVICE AGREEMENT, WHICH IS GOVERNED BY THAT AGREEMENT'S OWN TERMS) WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID US, IF ANY, FOR USE OF THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless Comfort Heating & Air and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) any information you submit through the Site that is false, misleading, or infringing.

California residents have specific privacy rights, including the right to opt out of any sale or sharing of personal information and to know, delete, or correct the information we hold about you. 13. Governing Law & Venue

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws principles. Subject to the arbitration agreement below, you agree that any action not subject to arbitration will be brought exclusively in the state or federal courts located in Saline County, Kansas, and you consent to personal jurisdiction and venue there.

14. Binding Arbitration & Class Action Waiver

Please read this section carefully — it affects your legal rights.

Except for disputes that qualify for small-claims court or claims for injunctive relief to protect intellectual-property or confidentiality rights, you and Comfort Heating & Air agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our Services will be resolved by final and binding arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its consumer arbitration rules then in effect, conducted in Saline County, Kansas, or another mutually agreed location, or by telephone/video where permitted by the rules. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You and Comfort Heating & Air agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. Neither party may act as a class representative or participate as a member of a class of claimants. If this class-action waiver is found unenforceable as to a particular claim or dispute, that claim or dispute will proceed in court rather than in arbitration, but the remainder of this arbitration agreement will still apply to all other claims and disputes.

Right to opt out. You may opt out of this arbitration agreement and class action waiver by sending written notice to [email protected] or the mailing address below within thirty (30) days of the date you first became subject to these Terms (for example, the date you first submitted a form on the Site). Your opt-out notice must include your name, the service address or account you used, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms or your relationship with us.

15. Dispute & Notice Procedure

Before filing an arbitration demand or a court action for any dispute not subject to arbitration, you agree to first contact us at [email protected] or (785) 822-7550 and describe the dispute so we have a good-faith opportunity to resolve it informally within thirty (30) days.

16. Pricing, Billing & Financing

Pricing for actual HVAC service is set out in your signed service agreement, work order, or invoice, not on this Site. Promotional pricing shown on the Site is subject to change and to the specific terms stated with that promotion. Where financing is offered, it is provided through our third-party partner, Optimus, and is subject to credit approval and Optimus's own terms; Comfort Heating & Air does not extend credit directly and does not process or store your financing-application data (see Section 9 and our Privacy Policy).

17. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Arbitration, and Governing Law) will survive.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any signed service agreement or work order governing actual HVAC service, constitute the entire agreement between you and Comfort Heating & Air regarding the Site and supersede any prior agreements regarding the Site.

20. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated effective date. Your continued use of the Site after a change becomes effective constitutes acceptance of the revised Terms.
